Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. THIS SWEEPSTAKES
IS OPEN ONLY TO THOSE LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE
DISTRICT OF COLUMBIA WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF DATE
OF ENTRY, WHO HAD INTERNET ACCESS PRIOR TO NOVEMBER 7, 2006 AND WHO MEET THE
ELIGIBILITY REQUIREMENTS DETAILED BELOW. The "Tenacious D in the Pick of
Destiny Sweepstakes" (the "Sweepstakes") starts at 6:00 pm (Eastern Daylight
Time) on or about November 7, 2006 and ends at 11:59 pm (Eastern Daylight
Time) on December 2, 2006 (the "Promotion Period").
TO ENTER: To enter via the Internet, log on to the website at
www.theonion.com (the "Website") and follow the entry directions, providing
your first and last name, mailing address, city, state, zip code, telephone
number (with area code), e-mail address, gender and birth date. ALL ENTRIES
MUST BE RECEIVED BY THE END OF THE PROMOTION PERIOD IN ORDER TO PARTICIPATE.
LIMIT ONE ENTRY PER PERSON OR HOUSEHOLD OR E-MAIL ADDRESS. Entries in excess
of this limit will be void.
The Onion, Inc., ("Sponsor"), New Line Productions, Inc. ("New Line") and
their respective affiliates, subsidiaries, parent corporation, and their
respective officers, directors, shareholders, employees and agents
(collectively, the "Sweepstakes Entities"), and any and all Internet servers
and access provider(s) are not responsible for: any incorrect or inaccurate
entry information; human error; technical malfunctions; failures, omission,
interruption, deletion, or defect of any telephone network, computer online
systems, computer equipment, servers, providers, or software, including any
injury or damage to participant's or any other person's computer relating to
or resulting from participation in this Sweepstakes; inability to access the
Website; theft, tampering, destruction, or unauthorized access to, or
alteration of entries; data processing that is processed late or incorrectly
or is incomplete or lost due to telephone, computer or electronic
malfunction or traffic congestion on telephone lines or the Internet or any
web site; printing or other errors; or any combination thereof. Proof of
entering information at Website is not considered proof of delivery or
receipt. Illegible, incomplete and duplicate entries will be disqualified.
All entries become the property of the Sponsor and will not be returned.
False and/or deceptive entries or acts shall render entrants ineligible. By
participating in the Sweepstakes, entrant affirms that he/she has read,
accepted, and agrees to abide by these Official Rules.
Potential winners will be selected in a random drawing from among all
eligible entries, on/about 12/4/2006 by representatives of the Sponsor,
whose decisions are final and binding in all matters relating to this
Sweepstakes. Potential winners will be notified by e-mail using the contact
information provided at the time of entry within seven (7) days of the
drawing date. Potential winner will be required to respond to the
notification e-mail within three (3) business days or his/her entry will be
disqualified and his/her prize may be forfeited and an alternate potential
winner may be selected. If an entrant changes his/her e-mail address after
he/she enters the Sweepstakes, it is his/her sole responsibility to notify
the Sponsor by (postal) mailing notice to the Sweepstakes Administrator
address (listed below) to be received by the end of the Sweepstakes.
Sponsor shall have no liability for any winner notification that is not
received by the potential winner for any reason. Prize must be accepted in
its entirety or forfeited. Prize winners (their parent/legal guardians if
residents of a jurisdiction that deems them to be minors) may be required to
execute and return a completed and notarized Affidavit of
Eligibility/Release of Liability and (except where prohibited) Publicity
Release and a completed IRS W-9 form within 14 days of issuance or potential
winner may be disqualified and an alternate potential winner may be selected
at the sole discretion of the Sponsor and Sweepstakes Entities. If any prize
notification or a prize is returned to Sponsor or its fulfillment companies
as undeliverable for any reason, it will be awarded to an alternate in a
subsequent random drawing from among eligible entries. No substitution by a
winner for a prize will be permitted. Prizes are not transferable,
assignable or redeemable for cash. No cash alternative or prize
substitutions will be allowed except that Sponsor retains the right to
substitute a prize of comparable or greater value in the event the prize is
unavailable, in whole or in part, for any reason.
All Federal, state and local tax liabilities, if any, are the responsibility
of the winners. Acceptance of a prize constitutes winner's permission for
Sponsor and New Line to use the winner's name, photograph, likeness, voice
and statements for publicity purposes worldwide and in all forms media now
known or hereafter developed, in perpetuity, without additional notice,
compensation or limitation, except where prohibited by law or Sponsor's
Privacy Policy.
Prizing:
One (1) Grand Prize is available. The Grand Prize Winner will receive:
* One (1) Autographed Gibson guitar, with an approximate retail value ("ARV") of $415.00.
* One (1) ONION GRAND PRIZE PACK, with an ARV of $150.00
Total ARV of Grand Prize: $565.00
Three (3) First Prizes are available. Each First Prize Winner will receive:
* One (1) PAIR OF TICKETS TO TENACIOUS D CONCERT SERIES, with an ARV of $100.00.
* One (1) The Onion FIRST PRIZE PACK, with an ARV of $25.00
Total ARV of First Prizes: $125.00 each, $375.00 total
TOTAL ARV of all Prizes: $940
Odds of winning a prize are determined by the total number of eligible
entries received for the Sweepstakes during the Promotion Period. Limit one
(1) prize per person. Winners are solely responsible for all costs,
incidentals, and any other expenses not specifically mentioned as being
included herein, including but not limited to, any required installation or
requested product upgrades/options.
ELIGIBILITY: This Sweepstakes is open only to legal residents of the 50
United States and the District of Columbia who are eighteen (18) years of
age or older as of date of entry and who had Internet access prior to
November 7, 2006. Officers, directors and employees, their immediate
families (parents, children, siblings, spouses), and those living in the
same household of employees (whether related or not) of Sponsor and
Sweepstakes Entities are not eligible to enter the Sweepstakes or win a
prize. All Federal, state and local rules and regulations apply. Void where
prohibited or restricted by law.
GENERAL RELEASE: Entrants release and waive any claim they may have against
Sponsor and Sweepstakes Entities for any injuries (including death and/or
disability), claims, damages or losses, costs or expenses of any kind
resulting from acceptance of, receipt, possession, use or misuse of a Prize
or parts thereof, human error, incorrect or inaccurate transcription of
entry information and/or from participation in this Sweepstakes or in any
Sweepstakes related activity. Entrants agree that the Sweepstakes Entities
have not made any warranty, representation or guarantee express or implied,
in fact or in law, with respect to any prize, including without limitation,
to such prize's quality or fitness for a particular purpose.
The Sponsor reserves the right to terminate on-line entry if technical
difficulties compromise the integrity or ability to continue on-line entry.
If on-line entry is terminated, notification will be posted on the Website.
Any attempt by an entrant or any other individual to deliberately damage the
Website or undermine the legitimate operation of the Sweepstakes is a
violation of criminal and civil laws and should such an attempt be made, the
Sponsor reserves the right to seek damages and other remedies from any such
person to the fullest extent permitted by law. All correctly completed and
eligible entries received on-line as of the end of the Promotion Period or
earlier termination date will be included in the random drawing. Where a
dispute arises about who submitted an on-line entry, the entry will be
deemed submitted by the authorized holder of the e-mail account entered. In
the event of a dispute as to the identity of an entrant cannot be resolved
to Sponsor's satisfaction, the entry will be deemed ineligible.
PRIVACY: Personal information submitted in connection with the Sweepstakes
shall be treated in accordance with these Official Rules and The Onion's
privacy policy located at www.theonion.com. Additionally, if an entrant
chooses to opt-in to receive additional e-mail communication from a
participating Sweepstakes Entity, and such entrant agrees to have his/her
personal information shared with that Sweepstakes Entity, such information
shall be subject to that Sweepstakes Entity's privacy policy and terms of
service (if applicable) and as a result, such entrant may receive additional
e-mail communication or promotions from that Sweepstakes Entity. Respective
privacy policies of Sweepstakes Entities participating in opt-ins will be
accessible from Sweepstakes entry page. New Line's privacy policy is posted

NOTE: Internet entry must be made by the entrant, only at the Website.
Entries made by any other individual or any entity and/or originating at any
other Internet website or e-mail address, including but not limited to
commercial sweepstakes subscription notification and/or entering service
sites, will be declared invalid and as such ruled ineligible for this
Sweepstakes.
